VI.4) PROCEDURES FOR APPEAL VI.4.1) Body responsible for appeal procedures To be advised VI.4.2) Lodging of appeals Precise information on deadline(s) for lodging appeals: Sanctuary Scotland Housing Association Limited will allow the relevant standsill period to elapse at the point when information on the award of the contract is communicated to bidders. The relevant standstill period is 10 days from the date on which Sanctuary Scotland Housing Association Limited notifies bidders of the award of the contract if using electronic means, or 15 days if using other means. This period allows unsuccessful bidders to consider the information provided by Sanctuary Scotland Housing Association Limited before the contract is entered into. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contract (Scotland) Regulations 2006 (SSI 2006 No. 1), as amended, provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the relevant Sheriff Court or the Court of Session. Any such action must generally be brought within three months (or within 30 days in the case of proceedings seeking an ineffectiveness order). Where a contract has not been entered into, or if it has been entered into and the proceedings are brought within 30 days of the date referred to above, the Court may order a setting aside of the award decision, or grant an effectiveness order, and order Sanctuary Scotland Housing Association Limited to amend any document and may award damages.
